Warranty & Liability

Most tuning shops publish a warranty page that warrants nothing. This one says plainly what we stand behind, what we do not, and what happens when something goes wrong — because a client who knows the boundary before the work is a client who is not surprised after it.

01What we stand behind

Apex Tuning warrants the workmanship of the calibration itself: that the file delivered for your vehicle was written for that vehicle, on its declared hardware and fuel, and that it runs as described in the agreed scope of work.

If a delivered calibration is defective in that sense — it will not flash, it will not run correctly, it produces a fault directly attributable to the mapping we wrote, or it does not deliver the described behaviour on the declared hardware — we correct it.

  • Revisions to correct a calibration defect are free, for the life of that calibration on that vehicle.
  • Bench time and labour to reflash a corrective revision are free.
  • Where a defect cannot be corrected, we restore the factory calibration at no charge.

This is a workmanship commitment on our own work. It is not a mechanical warranty on the vehicle, and it is not insurance against failure.

02What we do not warrant

We do not warrant the vehicle, its parts, or its future.

  • Mechanical or electronic components: engine, turbocharger, transmission, clutch, driveline, cooling system, sensors, wiring and control units themselves.
  • Pre-existing conditions and hidden defects, including wear that had not yet presented as a fault when the vehicle arrived.
  • Failures caused by deferred maintenance, poor fuel quality, incorrect fuel grade, contaminated oil, or overheating.
  • Failures caused by parts fitted by others, or by a calibration flashed by anyone other than Apex Tuning.
  • Consequential losses: towing, storage, rental vehicles, lost income, missed events, or reduction in the vehicle's resale value.
  • The magnitude of a power figure, where the delivered calibration performs as described. Estimated figures published on this site are projections, not guarantees.

03Manufacturer warranty

Modifying a control unit can void your manufacturer or extended warranty, in whole or in part. That is the manufacturer's decision, not ours, and we cannot overrule it.

Federal law does not permit a manufacturer to void an entire warranty merely because a vehicle has been modified; it does permit the manufacturer to deny a claim where the modification caused the failure. In practice, dealers do detect flash counters and calibration identifiers, and returning a factory file does not erase every trace of a modification.

Assume the warranty is at risk. If keeping it intact matters more to you than the power, tell us before the appointment and we will tell you honestly whether to proceed.

04Emissions, inspection and road legality

Calibrations are supplied for off-road, race and competition use. Apex Tuning makes no representation that any modified vehicle is compliant with federal, state or local emissions law, will pass an inspection, or may lawfully be operated on a public road.

We do not remove or defeat emissions control equipment on vehicles intended for road use, and we decline requests to do so.

Responsibility for registration, inspection, insurance disclosure and legal operation rests entirely with the Client.

05Revisions and support

A calibration is not a single event. Fuel changes, seasons change, and hardware gets added.

  • Revisions to correct a defect in our work: free, no time limit, as above.
  • Revisions requested because the vehicle's hardware, fuel or intended use has changed: quoted as new work.
  • Datalog review and advice on a vehicle we calibrated: free, and we would rather you sent the log than guessed.
  • Support is tied to the vehicle by VIN and does not transfer to a new owner without our written agreement.

06If something goes wrong

Stop driving the vehicle and contact us before anyone else opens it. A failure that has already been disassembled by a third party usually cannot be diagnosed, and that alone can end a claim.

  • Call us. Send the fault codes and the most recent datalog if the vehicle can still produce one.
  • We review the logs against the calibration we delivered and give you our reading in writing.
  • Where the evidence points at our calibration, we correct it under Section 1 and cover the associated bench and labour time.
  • Where the evidence points elsewhere, we say so, show you the data behind that conclusion, and help you take it to the right party.
  • Where the evidence is genuinely inconclusive, we will say that too rather than assign blame we cannot support.

Claims should be raised within 30 days of the fault appearing, while the datalogs still exist.

07What voids calibration support

  • An undisclosed modification, fault or previous calibration.
  • A flash performed by another party after ours.
  • Running a fuel grade lower than the one the calibration was written for.
  • Removing, disabling or bypassing a sensor or safety strategy the calibration depends on.
  • Continuing to drive the vehicle after a fault light or a knock event, before contacting us.

08Limits

Total liability under this policy is limited to the amount paid for the calibration service concerned, consistent with the Limitation of Liability section of the Terms of Service.

Nothing in this policy excludes any right you hold under the consumer protection law of your state that cannot lawfully be excluded, or liability for death or personal injury caused by our negligence, or for fraud.
